I realize that the Odawa Youth Summer Cycling program (“Program”) involves bicycling, that there are dangers and risks inherent to bicycling, and that it is impossible to delineate each and every risk. INHERENT RISKS include, but are not limited to: uneven, irregular, and slick surface conditions and terrain; marked and unmarked obstacles and features, both natural and manmade; unpredictable and adverse weather and visibility conditions; negligence of myself, other participants, and/or trail users on foot, bicycles, vehicles, animals, or other means of transportation; equipment failure; inadequate safety equipment; and physical exertion. I recognize that the INHERENT RISKS and other risks and dangers could result in serious trauma, injury, and even death. In consideration of my child or ward being permitted to participate in the Program, I freely and expressly assume all risks of injury and death to the participant and of property loss or damage attributable to participation or to the negligence of the Little Traverse Bay Bands of Odawa Indians (“LTBB”), its employees, agents, officials, and volunteers (“Released Parties”). I agree to release and forever discharge the Released Parties from all responsibility and liability for injuries, damages, or losses that result from my child or ward’s participation in the Program. I further agree not to sue or make claim against a Released Party, and to defend, indemnify, and hold harmless the Released Parties and other Program participants from all claims and for all expenses incurred as a result of my child’s participation in the Program. I AUTHORIZE LTBB Odawa Youth Cycling Program and its employees or representatives to treat minor injuries/non-life threatening injuries (i.e. scrapes/bruises), to call for medical care for my child, and to transport my minor child to a clinic or a hospital if they believe urgent action is necessary. I understand that this assumption of the risk agreement, release of liability, and covenant not to sue is a contract between myself and the LTBB and I accept it voluntarily. I agree that it is binding on myself, my heirs, and my family, including my child, and I warrant and covenant that I have full legal authority to enter into this agreement on behalf of the foregoing parties. By signing below, I understand and agree to the abovementioned information and AGREE TO PAY all costs associated with medical care and transportation for my minor child. For myself and the minor for whom I am signing, I have carefully read and fully understand this agreement and I agree to its contents. Please sign below:
