NOTICE OF COLLECTIVE ACTION LAWSUIT

If you deliver or have delivered telephone directories for Directory Distributing Associates, Inc., you may be entitled to additional pay for minimum wages and/or overtime pay:

TO ANYONE:

1)    hired by Directory Distributing Associates, Inc. during the period from June 25, 2009, to the present to deliver AT&T telephone directories, and

2)    classified by Directory Distributing Associates, Inc. as an independent contractor.

A few directory delivery workers allege that they were employees rather than independent contractors and allege that they are entitled to additional pay.  If you deliver or have delivered telephone directories, you may be entitled to additional pay.  If you qualify and want to ask for additional pay, you must send a consent form.  If you do not want to ask for anything, simply do nothing. This Notice and its contents have been authorized by the District Court of Harris County, Texas, 269th Judicial District.

Can I Be In the Lawsuit?
You may claim additional pay if you deliver or have delivered telephone directories for Directory Distributing Associates, Inc. on or after June 25, 2009 -- but you have to sign up.

What is this lawsuit about?
Some former and current directory delivery workers say their time was not accurately recorded, they were not paid the minimum wage, and they were not paid overtime pay

What can I get?
If the directory delivery workers win, you may get additional pay for unpaid wages and overtime hours.
If the directory delivery workers lose, you will get nothing.

What if I am not a U.S. citizen?
It does not affect your right to be included in this case.  You will never be asked about your citizenship status.

Will I get fired if I sign up?
It is against the law to fire or demote you or cut your pay because you participate in this case.

How do I make a claim?
If you wish to make a claim for additional pay, fill out the enclosed consent form and mail it.  It must be mailed by March 29, 2013.  Or, you can sign the form electronically at the website below.
